Your use of Fiction Pub AI, including any sub-domains thereof, affiliated websites, and mobile applications (collectively, the "https://beta.fictionpub.ai"), which are owned and maintained by FictionPub, LLC ("FictionPub," "we," "our," "us"), are governed by the policies, terms, and conditions set forth below.

By accessing, using, placing an order, or making a transaction over the Website, you agree to the terms set forth herein, and further acknowledge and understand that by purchasing or accessing digital products, you are being granted a revocable, non-exclusive, non-transferable license to access and use the digital products. This license may be revoked at any time at the discretion of FictionPub, and the terms of use are subject to change in accordance with FictionPub's policies.

THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW IN SECTION 15 OR IF YOU OPT-OUT.

FictionPub Beta Terms of Use

1. Nature of Beta Program

The terms in this section apply exclusively to individuals who have completed the checkout process as beta users and have received confirmation of their beta status in their order confirmation.

If you participate in the FictionPub Beta Program ("Beta"), you acknowledge and agree that you are using a pre-release, experimental version of the FictionPub software and related services ("Beta Service"). The Beta Service may contain bugs, errors, or defects, and may be subject to change, interruption, suspension, or discontinuation at any time without notice and at our sole discretion.

We do not guarantee the availability, uninterrupted use, or continued access to the Beta Service. We may modify, suspend, or terminate your access to the Beta Service at any time and for any reason or no reason, with or without notice. You expressly accept all risks associated with use of the Beta Service.

2. Beta Rewards and Credits

FictionPub may, at its discretion, offer Beta users rewards for completing writing challenges or other activities. Any such rewards, including credits or promotional access, are a discretionary benefit, subject to conditions communicated to you (such as word count or submission deadlines), and are non-transferable, with no cash value.

FictionPub may modify or cancel Beta rewards at any time where necessary (for instance, in cases of abuse, fraud, or technical issues), but will act in good faith toward participants.

Conditions for eligibility, redemption, or use of any Beta rewards or credits will be provided at the time of the offer, and FictionPub is under no obligation to continue or renew any reward or credit for Beta users.

3. License to User Content for Beta Purposes

You retain ownership of the ideas, plots, characters, text, information, communication, or materials that you upload, import into, or create using the Beta Services ("Beta User Content"). As between you and FictionPub, you retain all rights and ownership of your Beta User Content.

By using the Beta Services, you grant FictionPub a worldwide, royalty-free, non-exclusive license to (1) store, process, analyze, and review your Beta User Content; and (2) use de-identified or aggregated versions of such content. FictionPub will use Beta User Content for the purposes of operating, maintaining, and improving the Beta Services, which may include training, refining, or enhancing underlying AI models and related systems.

Website Use & Conduct

You must be at least 18 years of age or the age of majority in your jurisdiction to use this Website. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract.

You agree not to use the Website for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Website in any way that could damage the Website, the services, or the general business of FictionPub.

Prohibited activities include: hacking, harassment, discrimination, IP infringement, spreading malware, or misusing payment flows
FictionPub may suspend or terminate access if you violate these rules, provide false information, dispute payments in bad faith, or otherwise risk the platform's security
Termination is immediate and does not trigger refunds

Payment & Refund Policy

All prices are in U.S. Dollars. By submitting payment details you confirm authorization, accuracy, and sufficient funds. We may receive updated card credentials from issuers; contact your issuer to opt out.

All sales are final once access is delivered. We do not issue refunds for dissatisfaction, lack of use, unmet expectations, or technical issues originating from your device or connection.

You must not request or create content involving minors, non-consensual acts, or unlawful activity
AI outputs may contain errors; you are responsible for verifying originality, accuracy, and compliance before publishing
Account sharing is prohibited. Notify us immediately of breaches or unauthorized access

Intellectual Property & User Content

Except for the user content you submit, all materials on the site are owned or licensed by FictionPub and protected by intellectual property laws. You may not copy, distribute, sublicense, or create derivative works without written permission.

You retain ownership of your manuscripts, ideas, prompts, and outputs. To operate the service we receive a limited license to host, process, and secure that content. We will not use it for public marketing without your consent, though we may use de-identified data to train or improve AI models.

Sharing features are optional; anything you publish may be copied by others
Deleting content removes it from active storage, but residual backups may persist temporarily

Disclaimer of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FICTIONPUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FictionPub does not warrant that the Website will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. No advice or information obtained from FictionPub shall create any warranty not expressly stated in these Terms.

Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FICTIONPUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL FICTIONPUB'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED FIVE HUNDRED U.S. DOLLARS (USD $500.00).

Dispute Resolution by Mandatory Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND WILL HAVE A SUBSTANTIAL IMPACT ON HOW CLAIMS YOU AND FICTIONPUB HAVE AGAINST EACH OTHER ARE RESOLVED.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Website (collectively, "Disputes") will be settled by binding arbitration between you and FictionPub, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

YOU ACKNOWLEDGE AND AGREE THAT YOU AND FICTIONPUB ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND FICTIONPUB OTHERWISE AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF ANY CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration will be administered by the American Arbitration Association ("AAA") under the Federal Arbitration Act
The arbitrator may only resolve disputes or claims between you and FictionPub and may not consolidate claims or proceedings without FictionPub's consent
You may opt out of arbitration within 30 days of purchase by writing to: FictionPub Information Products LLC, Attn. Legal Department, stating your name, the product you purchased, and your intent to opt out of arbitration

Additional Terms

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless FictionPub, its parent, subsidiaries, predecessors, successors and affiliates, and their respective partners, officers, directors, agents, representatives, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from and against any and all claims, actions, losses, liabilities, damages, expenses, demands and costs of any kind, including, but not limited to, reasonable attorneys' fees.

Electronic Communications

You agree that we may communicate electronically with you and that such communications, as well as notices, disclosures, agreements, and other communications that we provide to you electronically, are equivalent to communications in writing and shall have the same force and effect as if they were in writing and signed by the party sending the communication.

Entire Agreement

These Terms, the Agreement, and any policies or operating rules posted by us on the Website or in respect to the Website constitute the entire agreement and understanding between you and FictionPub and supersedes and replaces any prior or contemporaneous agreements.
